Ellingson moved and Reinke seconded that the following resolution be adopted:

WHEREAS, the Charter for the City of Ortonville ("Charter") establishes the authority of the Council of the City of Ortonville ("Council") to declare that a vacancy exists in any elective office by reason of the failure of such official without good cause to perform any of the duties of such office, and

WHEREAS, Charter further sets forth conditions to be met for the removal of such official, and

WHEREAS, Council Member William Hynnek has missed numerous Council meetings and has further failed to attend appointed board and committee meetings,

NOW THEREFORE BE IT RESOLVED, by the Council of the City of Ortonville, Minnesota as follows:

1. Pursuant to Charter provision 2.06, Council Seat "A" may be deemed vacant due to the failure of William Hynnek to perform duties of such office.
2. A public hearing is hereby called for this matter on November 20, 2000 at 6:00 p.m. at the City Council Chambers at 315 Madison Avenue.
3. That notice of said public hearing shall be published in the City’s official newspaper not less than 10 days prior to said public hearing.

Upon roll call vote the following voted aye: Dorry, Gustafson, Ellingson, Dinnel, Reinke, Oakes, and the following voted nay: none.

Resolution 00-162 passed this 23^rd day of October 2000.
