Oakes moved and Ellingson seconded that the following resolution be adopted:

RESOLUTION 00-163

RESOLUTION APPROVING WATER SALES TO BIG STONE CITY

WHEREAS, The City of Big Stone City, South Dakota ("Big Stone") wishes to purchase additional 150,000 gallons of water capacity from the City of Ortonville, Minnesota ("City") water plant, and

WHEREAS, City considers it possible to offer such water capacity either by payment in advance for said capacity or by a monthly surcharge.

NOW THEREFORE BE IT RESOLVED by the Council of the City of Ortonville, Minnesota that:

  1. City hereby agrees to sell an additional 150,000 gallons of water capacity per day to Big Stone for the cost of $225,000.00 and for the same rate of Big Stone’s first 100,000 gallons as rates may be from time to time.
  2. City hereby agrees that Big Stone can instead choose to purchase the additional 150,000 gallons per day capacity for a surcharge of $.24 per 1,000 gallons for all water purchased on a monthly basis.
  3. City Attorney is hereby instructed to draft necessary documentation upon Big Stone’s selection of the offered options.
  4. This offer is contingent upon review and final approval of City Attorney prepared agreement.

Upon roll call vote the following voted aye: Gustafson, Ellingson, Reinke, Oakes, Dinnel, Dorry, and the following voted nay: None.

Resolution 00-163 passed this 23rd day of October 2000.
