Dinnel moved and Gustafson seconded that the following resolution be adopted:

RESOLUTION 00-170

RESOLUTION DESIGNATING RESIDENCE HAZARDOUS BUILDING

 

WHEREAS, many complaints have been received by the City Council with respect to the conditions of the building owned by Timmy and Mandy Barber and Panda Johnson in the City and described as:

 

836 Southeast Second Street, Ortonville, Minnesota

 

hereinafter called Premises, and

 

WHEREAS, the City Council of the City of Ortonville has had its building inspector and City Clerk make inspection of the Premises above described, and

 

WHEREAS, the building inspector and City Clerk have filed with the Council their report and findings of the hazardous and substandard condition of said Premises,

 

NOW THEREFORE, BE IT AND IT IS HEREBY RESOLVED, by the City Council of the City of Ortonville that based upon the building inspector's and City Clerk/Administrator's report of the hazardous and substandard condition of the Premises owned by Timmy and Mandy Barber and Panda Johnson in the City of Ortonville at 836 Southeast Second Street and which report is hereby incorporated herein by reference, the City Council finds as follows:

 

FINDINGS

 

1. That Timmy and Mandy Barber and Panda Johnson are the owners of the home dwelling in said City, described as 836 Southeast Second Street.

 

    1. The building is unoccupied; the roof overhead is rotten and deteriorating; there are holes in the asphalt roofing and evidence that the roof leaks; the window sashes are rotted and deteriorating; the interior is littered with paper, leaves and debris constituting a great fire hazard; the rain gutters are falling broken and falling down; the exterior wall has a hole in it; yard is full of debris, the yard contains an abandoned vehicle; that this building is a greater fire hazard due to the accumulation of flammable materials, and due to the fact that this building is open, vacant and unattended; that this building constitutes a hazard to public health because of the unsanitary conditions; that this building constitutes a hazard to public safety because of physical damage, dilapidation and inadequate maintenance; and that by reason of the above facts such building constitutes a hazardous building within the definition of Minn. Stat. §463.15 to 463.26.

 

Upon roll call vote the following votes were recorded:

 

YES: Oakes, Dinnel, Gustafson, Reinke

 

ABSENT: none
