Oakes moved and Reinke seconded that the following resolution be adopted:

RESOLUTION 02-040

RESOLUTION APPROVING AMENDED WATER AGREEMENT

FOR SALE OF WATER TO BIG STONE CITY

WHEREAS, the Council of the City of Ortonville (“Council”) had previously approved an agreement for the sale of water to the city of Big Stone City, South Dakota (“Agreement”), and

WHEREAS, certain changes have since been recommended be made to Agreement, and

NOW THEREFORE BE IT RESOLVED by the Council that:

1.    The Agreement is hereby approved as amended as of April 16, 2002 and as is on file at the City Clerk’s office.

2.      That the Mayor and Clerk-Administrator be and are hereby authorized to execute amended Agreement as shall be prepared by city attorney’s office.

Upon roll call vote the following voted aye: Dinnel, Sellin, Arndt, Oakes, Berkner, Reinke, and the following voted nay: none.

Resolution 02-040 passed this 15^th day of April 2002.
